2. Definitions
Agency: Diyarkent Turizm
Consumer / Client: Any person purchasing travel services
Package Tour: As defined in the Package Tour Contracts Regulation
Suppliers: Airlines, hotels, transport companies, guides, etc.
3. Subject of the Contract
This contract regulates the rights and obligations of the parties regarding:
Package tours
Accommodation
Transportation
Ticketing
Other travel-related services
provided by the Agency.
4. Formation of the Contract
4.1 The contract enters into force upon payment of the deposit or full price.
4.2 Electronic, online, or written approvals are legally binding.
4.3 The Client confirms acceptance on behalf of all participants.
5. Prices and Payment
5.1 Prices are indicated in TRY or foreign currency in compliance with Turkish legislation.
5.2 Prices may change due to:
Exchange rate differences
Taxes, fees, fuel surcharges
5.3 Full payment must be completed within the period specified in the contract.
5.4 Failure to pay may result in automatic cancellation.
6. Package Tours (Paket Tur Hükümleri)
6.1 Package tours are subject to the Package Tour Contracts Regulation.
6.2 The Agency is responsible for the proper performance of all services included in the package tour, even if provided by third parties.
6.3 If a significant change occurs:
The Client may accept the change
Or terminate the contract without penalty
6.4 If the Agency cancels the tour:
The full amount is refunded
Or an alternative tour is offered
7. Consumer Right of Withdrawal
7.1 For package tours, the Client may cancel the contract:
By paying applicable cancellation fees
Or without penalty in cases defined by law
7.2 Cancellation fees are calculated based on:
Time remaining before departure
Supplier costs
8. Cancellations and Changes (Non-Package Services)
8.1 Airline tickets, hotel-only bookings, visas, and individual services are subject to Supplier rules.
8.2 These services may be non-refundable.
8.3 The Agency acts solely as an intermediary for non-package services.
9. Refunds
9.1 Refunds are made within the legally required period after deductions permitted by law.
9.2 Refunds are issued using the original payment method.
9.3 Banking and exchange expenses may be deducted where lawful.
10. Travel Documents and Obligations of the Client
10.1 The Client is responsible for:
Passport validity (minimum 6 months)
Visas and permits
Health requirements
10.2 The Agency is not responsible for denied boarding or entry due to missing documents.
11. Insurance
11.1 Package tours are covered by mandatory package tour insurance in accordance with Turkish law.
11.2 Personal travel insurance is recommended but optional.
12. Changes by Suppliers
12.1 Suppliers may make operational changes.
12.2 In package tours, significant changes are handled according to consumer protection legislation.
13. Force Majeure
Events such as natural disasters, pandemics, war, government decisions, or strikes are considered force majeure.
Rights arising from such events are governed by Turkish legislation.
14. Limitation of Liability
14.1 For package tours, liability is determined under Law No. 6502.
14.2 For non-package services, the Agency’s responsibility is limited to intermediary obligations.
14.3 Compensation shall not exceed the total service fee paid unless otherwise required by law.
15. Consumer Complaints and Legal Remedies
15.1 Complaints must be submitted in writing within 30 days after service completion.
15.2 Consumers may apply to:
Consumer Arbitration Committees
Consumer Courts
as regulated by Turkish law.
16. Personal Data Protection (KVKK)
Personal data is processed in compliance with Law No. 6698 (KVKK) and shared only with service providers when necessary.
17. Governing Law and Jurisdiction
This contract is governed by the laws of the Republic of Türkiye.
Authorized courts and enforcement offices are those of Turkey.
18. Acceptance
By making a reservation and payment, the Client declares that they have read, understood, and accepted all terms of this contract.
